全国各地都在履行按照国务院、省政府关于社会保险费征管职责划转工作部署，为确保2019年1月1日社保费征收主体由人社部门平稳有序移交到税务部门！

日前，国家税务总局、财政部、人力资源和社会保障部、国家卫生健康委员会、国家医疗保障局在北京联合召开社会保险费和非税收入征管职责划转工作动员部署视频会议，确保划转工作平稳落地进行统筹布置安排。

按照党中央、国务院决策部署，今年12月10日前要完成社会保险费和第一批非税收入征管职责划转交接工作，自2019年1月1日起由税务部门统一征收各项社会保险费和先行划转的非税收入。

在这里必须要提醒一下财务人员了，千万别用以下5种社保筹划方式！小心出大事！

社保入税在即，再次提醒各位财务同仁

以下5种筹划社保的方式不可取！

大家知道，目前不缴、少缴社保已经成为好多企业特别是私营企业的“潜规则”，因此明年社保入税，对于一直合规据实申报社保的企业并没有大的影响，但是对于一些不规范的私企来讲，确实将会大大加大人工成本！

好多财务人员想法设法来对社保进行“纳税筹划”，在此郑重地提醒各位财务同仁：以下5种筹划社保的方式不可取！

不可取方式一

比如公司发放员工的工资为8000元。有的会计人员筹划为通过公司账面发放3000元，另外的5000元通过一些收入不入账的私人账户资金来支付。

殊不知对于收入不入账的频繁交易的私人账户早已经纳入了大数据监控。

不可取方式二

比如公司发放员工的工资为8000元。有的会计人员筹划为通过公司账面发放3000元，另外的5000元通过让职工到处找费用票、甚至明示或者帮着员工统一买票来顶抵工资，从而少缴个税与社保。

殊不知对于虚开虚抵发票、费用变动异常的情况早已经纳入了税局的电子眼。

不可取方式三

比如公司发放员工的工资为8000元。有的会计人员筹划为工资+劳务费，也就是通过公司账面发放工资薪金3000元，另外的5000元通过员工去税局虚开劳务费发票顶抵工资，从而少缴个税与社保。

提醒：

对于同一个公司的同一员工，劳动关系和劳务关系不能并存。

不可取方式四

比如公司发放员工的工资为8000元。有的会计人员筹划为工资3000元，另外5000元属于不交社保的职工生活困难补助。

提醒：

免征个税与社保的职工生活困难补助是任职单位向员工支付的临时性生活困难补助。即由于某些特定事件或原因而给纳税人本人或其家庭的正常生活造成一定困难，任职单位给该员工的临时性生活困难补助。

只有符合规定的临时性生活困难补助才可以在计算社会保险费缴费基数时应予剔除。

不可取方式五

比如公司发放员工的工资为8000元。有的会计人员自以为是的筹划为这些人员不是公司的正式员工，属于临时工，不需要缴纳社保，直接做个临时人员工资发放表支付就可以。

提醒：

只要临时工与企业存在实际雇佣关系签订了劳动合同，同时参加单位的考勤、服从单位的规章制度管理，那么临时工与正式员工一样，应享受同等待遇，都需要申报个税与社保。

给法人和会计的2点提醒：

1、在社保入税的大环境下以及目前税收严管的时代，作为企业主和财务人员，只有做到依法纳税、合规经营，才可以长久安全地经营下去并立于不败之地。

2、提醒各位会计人员，切记不要造假、切记不要违背业务真实的面目，必须要合理合法运用政策，通过改变传统用工方式、结合优化员工薪酬体系等方面入手，从而达到既降低税负费率、又降低财税风险的目的。

以下4种企业需要特别注意

企业社保千万别这么缴

1、长期按照最低标准申报社保的企业

社保基数有上下限的规定，每个地方不一样。如果工资低于基数，按照最低标准缴纳，如果高于基数且不高于最高上限，则按照实际工资据实缴纳，如果高于最高上限，则按照最高上限缴纳。

以前长期按最低工资标准申报申报基数的单位，你的个税申报基数税务局是有的，两者一对比，差异过大，未足额缴纳的部分，补缴的可能性很大。

2、劳务派遣、物业安保、建筑劳务等用工多的企业

这些单位很多不会给职工办理申报，私下签订放弃社保协议的比比皆是，而一些建筑劳务公司还会大量做工资成本，在建筑用工未实名的庇护下，大量借用他人身份信息制作工资表，列支成本。

你的工资表信息、个人所得税信息、社保申报信息，企业所得税申报信息，现在都由一个部门来核查了。应缴未缴的行为更容易被曝光了。

3、拒缴社保费的企业

提醒1：关于时间安排

今年12月10日前要完成社会保险费和第一批非税收入征管职责划转交接工作，自2019年1月1日起由税务部门统一征收各项社会保险费和先行划转的非税收入。

下一步税务、社保、医保等部门将主要完成制定配套制度、建立对账机制、完成数据交换以及联调联试等工作。

提醒2：关于职责划分

征管职责划转后，税务部门负责社保费的征收管理，但是社保政策的制定、参保扩面、待遇发放等工作仍由社保部门负责。　

提醒3：关于缴费基数

单位职工本人缴纳基本养老保险费的基数原则上以上一年度本人月平均工资为基础，在当地职工平均工资的60%–300%的范围内进行核定，也就是最低不得低于平均工资的60%，否则就属于违规。

提醒4：关于社保两面性

税局全面接管社保的征收，对于部分不合规的中小企业确实带来了税费负担的增加，但是对于职工来说，是增加了社保的保障，保护了职工的权益。因此该项政策既是对在职职工未来社保权益的保障，也是对当前已退休职工待遇的保障，从而倒逼企业完善、合规经营。

提醒5：关于社保费率的降低

税局全面接管社保的征收，对于合规的企业不但没有税负增加的影响，相反随着社保费率进一步下降，对于依法缴费的企业来讲，税务征收后费负会逐步合理下降。今年，人社部、财政部联合发布《关于继续阶段性降低社会保险费率的通知》，自今年5月1日起，继续阶段性降低社会保险费率。9月6日的国务院常务会议也强调，要抓紧研究适当降低社保费率，确保总体上不增加企业负担。

提醒6：关于社保的缴纳

社保的缴纳不是愿意不愿意的问题，而是企业的必须的一项义务，虽然员工有自愿放弃享受社保的权利，但企业不能放弃缴纳社保的义务。

根据《中华人民共和国劳动法》第七十二条的规定：“社会保险基金按照保险类型确定资金来源，逐步实行社会统筹。用人单位和劳动者必须依法参加社会保险，缴纳社会保险费。”

提醒7：关于公积金的征收

社会保险费包括基本养老保险费、基本医疗保险费、工伤保险费、失业保险费和生育保险费。

住房公积金不在划转税局征收之列。

提醒8：关于纳税人的应对

我们关注到，这种情况下，企业计算社会保险的基数不是30000元，而应该是32608.70元（=30000÷92%），个人应承担的社保不再是2400元，而是2608.70（=32608.70×8%），同样，其企业应承担的社会保险也不再是6000元，而应该是6521.74元（=32608.70×20%）。

美国的FATCA与CRS有哪些不同

什么是FATCA？

FATCA是指“海外账户纳税法案”，这是一项美国法律，旨在防止未报告与非美国账户有关的收入的美国人（个人或实体）逃避税务。FATCA要求某些不在美国境内的PayPal分公司收集账户持有人的信息，以确定账户是否由美国人（由FATCA定义）持有。

为解决可能因FATCA的要求而受到影响的本地银行保密和隐私问题，交换账户持有人信息时须遵守美国与多个海外司法辖区达成的协议。依据FATCA提供给美国国家税务局（下称“IRS”）或当地监管机构的信息也受PayPal《隐私权保护规则》保护。

什么是CRS？

CRS：（Common Reporting Standard）中文翻译为“共同申报准则”，又称“统一报告标准”

CRS的提出者是经济合作与发展组织，也就是OECD（经合组织）。而概念是来自美国的美国海外账户税收遵从法（FATCA）。经济合作与发展组织（OECD）和G20组织为了维护诚信的税收体制，共同发布了《金融账户涉税信息自动交换标准》和多边管辖权协议（MCAA），这个系统也称为共同报告标准（CRS），简单来说CRS是推动国际税收事务而制订出的一套有关国际税务情报自动交换的新标准。

因美国并不属于OECD发布的已经签署或者承诺签署CRS的国家或地区，被列为非CRS参与国,其通过FATCA法案实现金融账户涉税信息交换。那么，同为金融账户信息交换制度，CRS与FATCA法案有什么不同呢?

为增加税收收入，打击美国纳税人利用海外账户偷逃税行为，美国国会于2010年3月18日通过了《海外账户税收遵从法案》（FATCA法案），该法案使得美国有能力在全球范围内收集纳税人的海外账户信息。

截至2014年7月份，已经有英国、德国、法国、加拿大、意大利、西班牙和澳大利亚等39个国家或地区同美国就FATCA法案达成了政府间协议，另有包括中国在内的60个国家或地区与美国就协定的实质性内容达成一致。欧盟《利息税指令》和美国FATCA为OECD出台金融账户信息交换标准提供了参照。

信息交换模式不同

FATCA模式：美国VS金融机构

FATCA法案的信息交换则包括两种合作模式

一是由缔约国政府承诺向其金融机构搜集信息并自动移交给美国国家收入局（IRS）；【金融机构—缔约国政府—美国IRS】

这里又分单边或双边交换模式。

中国与美国协定的是双边交换模式。

二是要求缔约国的金融机构直接向IRS报告美国纳税人的账户信息。缔约国应当保证其金融机构与美国签订合作协议。【金融机构—美国IRS】

要求金融机构其持有的金融账户信息展开尽职调查，辨别并定期提供其掌握的美国账户（包括自然人账户以及美国纳税人持有比例超过10%的非金融机构）信息。这些信息包括：美国纳税人的姓名、地址、纳税识别号、账号、账户余额或价值以及账户总收入与总付款金额。

不愿意加入FATCA游戏规则的，美国也有自己的“流氓政策”，即对于不配合的外国金融机构，其来源于美国的包括股息、利息在内的收入将会被强加30%的预提所得税作为惩罚。

CRS模式：国家VS国家

CRS是基于完全互惠模式的自动信息交换。这主要体现在CAA文本中。

第一批实施CRS的54个国家和地区中，已经有48个成功参与了“配对”，剩下6个国家目前仍在进行本国CRS立法或者对CRS实施所需要的数据保密和安全操作以及IT系统进行完善。

不同对象的不同标准

FATCA主要影响的是在美国外有账户的美国人、美国跨国公司及缔约国外国金融机构。

若缔约国与美国签订FATCA法案，并选择双边模式，即对等交换信息。但由于FATCA法案是美国的国内法律，要求外国金融机构履行美国法案下的合规义务，面临着跨国间的法律障碍。

CRS影响的是100多个签约国的非税务居民，影响范围更为广泛。有些人即使不需要根据FATCA上报财务账户，但是在CRS下，就需要上报。

FATCA只针对余额超过50000美元的个人账户，以及不同限制的公司账户。而CRS没有最低金额限度，存量账户，个人低净值账户按照账户持有人的地址来确定税收居民身份；（同一家金融机构及其关联机构账户加总余额不超过600万美元），个人高净值账户根据记录检索和客户经理程序来识别税收居民身份（加总余额超过600万美元）。

CRS是统一报告准则

CRS对金融机构的尽职调查与报告义务作了统一规定，承诺实施CRS的国家或地区执行单一标准，使得程序简化、高效，且大大降低管理成本。而FATCA作为美国国内法案，其执行必须通过美国逐一与各国谈签协议才能实现。而且，不同的协议执行标准未必一致。

金融机构分类范畴不同

FATCA或者CRS下对于实体(Entity)的分类十分重要，因为它关系到该实体在FATCA或CRS下是否需要承担以及承担何种合规义务的问题。任何实体，如果不属于金融机构（Financial Institution)的范畴，则应分类为非金融机构（Non-Financial Entity, “NFE”, 或者FATCA下的Non-Financial Foreign Entity, “NFFE”)。非金融机构本身并没有任何FATCA或者CRS下的合规义务。

根据非金融机构的业务类型，又可以进一步将其分类成积极非金融机构(Active NFE)和消极非金融机构（Passive NFE)。与积极非金融机构不同，消极非金融机构并没有一个明确的概念和细分类，而是一个默认的类别。原则上，如果一个非金融机构不属于积极非金融机构，则其应被分类成消极非金融机构。

需要注意的是，与美国FATCA的双边信息交换机制不同，CRS属于全球性的信息交换，为了防止个人通过在非CRS参与国设立投资机构（Investment Entity) 而不合理避税，CRS特别增加了一类消极非金融机构，即位于CRS非参与国的投资机构(Investment Entity)。

作为非金融机构，消极非金融机构本身没有任何FATCA或者CRS下的合规义务，不存在识别金融账户并搜集和申报金融账户信息的问题。但是如果消极非金融机构持有另外一家金融机构的金融账户时，该金融机构不仅需要识别该消极非金融机构的税收居民身份，同时需要“穿透”该消极非金融机构，识别出其实际控制人(Controlling Persons, 或 Substantial Owners), 看其是否属于需要申报的情形。

京东正式发布公告

第一阶段：如截止至12月7日，商家未上传或更新行业相关许可证件信息的，京东平台将依据平台规则扣除商家积分6分；

第二阶段：如截止至12月14日，商家仍未上传或更新行业相关许可证件信息的，京东平台将依据平台规则扣除商家积分25分并下架商家店铺所有行业相关类目下产品。

也就是说，京东平台的商家，3天内未上传或更新相关证件信息，将扣除商家6分。10天内未上传，直接扣除25分，并下架店铺所有行业相关类目产品！而其他平台或者电商经营者，无视法规或者未能满足新电商法要求的，将面临相关处罚。

按照《电子商务法》规定，电子商务经营者应当依法办理市场主体登记，并在其首页显著位置，持续公示营业执照信息、与其经营业务有关的行政许可信息。电子商务经营者应当依法办理市场主体登记。

如果违反规定，由市场监管部门责令限期改正，可以处1万元以下的罚款。电商平台经营者对违反规定的平台内经营者未采取必要措施的，由市场监管部门责令期限改正，可以处2万元以上10万元以下的罚款。

这样一来，对于自然人网店的小卖家而言，取得营业执照无疑增添了不小的成本，不少经营不善的商家，在这样的大环境下，可能会选择不再经营，短时间内商家用户数量会呈现下降趋势，但长期来看对电商经营有益。

除此之外，电商法交税问题也是商家关心的重点！

对此，《电商法》第十条、第十一条明确规定，电子商务经营者包括从事网络销售商品或提供服务经营活动的自然人、法人和非法人组织，应当依法办理市场登记，应当依法履行纳税义务，并依法享受税收优惠。

按照上述法律，电商卖家应该缴税，电商平台也应该配合提供数据。这也意味着在工商登记与税务的双重监管下，以自然人开设网店、从事网络销售的电商避税时代即将终结，这些店铺固有的价格优势也将随之缩水。就此而言，以低价为主要竞争力的高流量店铺，今后会遇到比较大的挑战。

但也有人表示，即便没有《电商法》，现有税法的条文也完全可以支撑，所有的电商卖家也都应当缴纳企业所得税、营业税等一切税款。可以肯定的是，淘宝C店和微商生态圈将因此迎来一轮洗牌。

个人出租不动产（不含住房）按照5%的征收率计算增值税应纳税额，向不动产所在地主管税务机关申报纳税；个人出租住房，按照5%的征收率减按1.5%计算增值税应纳税额，也是向不动产所在地主管税务机关申报纳税。

个人出租住房的，应纳增值税税款=含税销售额÷（1+5%）×1.5%；出租非住房，应纳增值税税款=含税销售额÷（1+5%）×5%。

这里的个人，指个体工商户和其他个人。

那如果出租方不是自然人，比如企业，税收也是一样的吗？

小规模纳税人

小规模纳税人即单位和个体工商户出租不动产（不含个体工商户出租住房），按照5%的征收率计算增值税应纳税额，个体工商户出租住房，按照5%的征收率减按1.5%计算增值税应纳税额。

一般纳税人

一般纳税人出租其2016年4月30日前取得的不动产，可以选择适用简易计税方法，按照5%的征收率计算增值税应纳税额。不动产所在地与机构所在地不在同一县(市、区)的，纳税人应按照上述计税方法向不动产所在地主管税务机关预缴税款，向机构所在地主管税务机关申报纳税。不动产所在地与机构所在地在同一县(市、区)的，纳税人向机构所在地主管税务机关申报纳税。

一般纳税人出租其2016年5月1日后取得的不动产，适用一般计税方法计税。不动产所在地与机构所在地不在同一县(市、区)的，纳税人应按照3%的预征率向不动产所在地主管税务机关预缴税款，向机构所在地主管税务机关申报纳税。不动产所在地与机构所在地在同一县(市、区)的，纳税人应向机构所在地主管税务机关申报纳税。一般纳税人出租其2016年4月30日前取得的不动产选择适用一般计税方法计税的，按照上述规定执行。
